Background Information
Claimant worked for insured for appx. three years prior to incident and was cleared to return to work under sedentary restrictions. His duties at the insured included framing, siding, plumbing and other home-improvement work. Claimant made $520.00/week while working for the insured. Claimant had no high school diploma but did obtain his GED in 1997. This claimant lived in Charleston, WV – a decent job market that we had to work with, which is always a plus!

This was a critical case for us as this was our first (trial) case for a potential client – a national carrier! So the pressure was on to produce!
During our initial assessment, claimant stated he had no idea what types of jobs he could do. Claimant also elaborated on his pain and swelling that he experiences each day from his injuries. Due to these comments, our focus was to locate true sedentary jobs that would allow a chair. With that said, given the admissions by the claimant as well as demeanor and attitude, we also suspected that the claimant may lack motivation to return to work. As a result, we utilized an aggressive strategy that brought a great result to the claim!
We scheduled a total of five job interviews for the claimant to attend. Per feedback from employers, the claimant failed to show to each of the five. As a result of our program’s ability to expose noncompliance when present, we leveraged our client to settle for much less, saving them $700,000 from a possible PTD outcome.
Conclusion
Workfinders USA was on this claim for approx. two months. The claimant eventually settled to avoid court, our testimony and our relentless documentation. The true value of our Return to Work program is being able to provide an effective loss mitigating strategy, result in substantial cost savings, by simply doing a little more in terms of RTW job development for our clients!
