Return-to-Work: New York
New York is favorable for our Permanently-Restricted RTW Program (non-classified claims) and our Transitional RTW Program.
New York has specific requirements for permanently-restricted claims, including:
- Claimants who are non-classified have a duty to demonstrate an 'attachment to the labor market.' Classified claims, as of 2017, no longer need to remain attached
- Claimant and attorney must be mailed all case documentation simultaneously
- NY WCB must be updated with all case documentation via email
